Terms and Condition

These terms and conditions ("Agreement") constitute a legally binding agreement between the client ("Client") and Thomas Faull ("Photographer") for  photography services. By engaging Photographer's services, Client agrees to the following terms:

1. Booking and Payment:

1.1 A non-refundable deposit of 50% of the total package price is required to secure the event date. The event date will be reserved only upon receipt of the deposit.

1.2 The remaining balance is due in full no later than 24 hours prior to the scheduled event. Photographer reserves the right to withhold services if payment is not received by the specified deadline.

2. Cancellation and Rescheduling:

2.1 In the event of cancellation by Client, the deposit is non-refundable. 

2.2 In the event that Photographer is unable to fulfill the agreement due to unforeseen circumstances (e.g., illness, equipment failure), Photographer will provide a full refund of any payments made by Client.

3. Event Details:

3.1 Client is responsible for providing accurate event details, including date, time, location, and any special instructions, before paying the deposit.

3.2 Client agrees to ensure the availability of necessary permissions and access to the event venue for Photographer to perform the agreed services.

4. Service Scope:

4.1 The specific services to be provided by Photographer are outlined in the chosen package. Any additional services requested by Client on the day of the event are subject to availability and may incur additional charges.

4.2 Photographer will use their professional judgment and experience to capture the best possible images, but cannot guarantee specific shots or outcomes.

5. Copyright and Usage:

5.1 Photographer retains copyright and all rights to the images captured during the event, including the right to use them for promotional purposes.

5.2 Client receives a non-exclusive, non-transferable license to use the images for their personal or business use only, including sharing on social media, printing, and displaying. Commercial use of the images requires written permission from Photographer and may incur additional fees.

6. Model Release:

6.1 Client grants Photographer the right to use images containing Client's likeness, guests, or event participants for promotional and marketing purposes.

7. Image Delivery:

7.1 Photographer will provide the edited images within 2 working days of the event date. The number of images delivered will depend on the package chosen.

7.2 Images will be delivered digitally, either through an online gallery or other agreed-upon method.

8. Indemnification:

8.1 Photographer shall not be held responsible for any injuries, damages, or losses incurred during the event.

8.2 Client agrees to indemnify and hold Photographer harmless against any claims, actions, demands, expenses, or liabilities arising out of or in connection with the event.

By booking the services of Photographer, Client acknowledges and agrees to the terms and conditions outlined above. This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, negotiations, and agreements.
